Terms and Conditions of Trade

  1. Company

  1. Customer

2.1 The Company, person or persons buying goods or services from Tom Leslie Bespoke Joinery Ltd 

 

  1. Price 

3.1 The price estimate is based on the details provided in the plans signed and agreed by the Customer. It does not include any stripping out costs (unless stated), electrical, plumbing or other finishing trades. 

3.2 The price is valid for 30 days from the date of the estimate. 

3.3 Appliances can be supplied at cost plus 15% (handling fee) and it will be the responsibility of the customer to register any product guarantees with the manufacturing company. 

3.4 The price estimate is based on measurements and dimensions supplied directly by the customer, from architects’ plans or from the initial site visit and consultation. Should these change for whatever reason then the Company retains the right to amend the pricing accordingly – reflecting time taken to amend drawings, alterations to material volumes, changes to production processes etc. 

 

  1. Timetable 

4.1 At the time of acceptance of the estimate, the Customer and Company will agree a timeframe for the project works. Should the customer not be in a position to maintain this timescale then the Company reserves the right to amend the price to reflect cost variances that may arise (material cost changes, product storage, disruption to production scheduling etc).  

4.2 Should the Company not be in a position to maintain the timescale, it will notify the Customer of such but there will be no cost variance to the Customer. 

 

  1. Payment 

5.1 A 50% deposit will be payable on acceptance of the final quotation and timeframe for installation.  

5.2 A 35% payment will be made on commencement of installation.  

5.3 The final 15%, plus any extras incurred throughout the project will be payable on completion of the project. 

5.4 All payments will be inclusive of VAT at the relevant rate. 

5.5 All payments to be made with 14 days of invoice issue 

5.6 The Company reserves the right to charge interest on any late payments at 3% above the bank base rate on the date the payment became due. 

5.7 Payments are to be made to:

  1. Risk/title 

6.1 All goods and materials will remain the property of the Company until the price of the goods has been paid in full, but the risk in the goods and materials will pass to the Customer on the date of delivery/installation. The Customer will be responsible for insurance from this date. 

 

  1. Installation

7.1 The Customer will be responsible for clearing the room/s of all loose fixtures and fittings and where this is not possible will agree with the Company what protection will be provided during the works. 

7.2 It is the responsibility of the Customer to source a suitable trade for the installation of appliances. The Company does not take responsibility for any appliance mis-installation or malfunction. The Company should be advised of any specific 

requirements needed to house selected appliances accordingly.

 

  1. Samples and Colour Match

8.1 Where appropriate the Company will provide materials and colour samples to be agreed with the Customer.  

8.2 The Company and Customer acknowledge that there is no absolute guarantee of an exact match between the sample and the finished product, as the use of natural materials can result in variations.

 

  1. Materials

9.1 The Company uses a variety of high quality materials that contain variations in colour, pattern, grain and knots and whilst every attempt will be made to match panels this cannot be guaranteed. Wood is a natural material that moves in response to changes in ambient moisture levels. The Company only selects wood that has been dried to the appropriate moisture level for our local climate. Whilst the production process allows the materials to respond to minor changes in environmental conditions we cannot accept responsibility for dimensional or structural issues caused by climate changes once the product has left the workshop.

 

  1. Guarantee 

10.1 Where the Goods have been manufactured by the Company and are found to be defective, or installation work by the Company is found to be defective, the Company shall repair or, at its sole discretion replace defective goods free of charge upon the following conditions; 

10.1.1 The Customer giving notice of the defect with 7 days of the defect coming to attention 

10.1.2 Such notice being served within 6 months of the date of invoice  

10.1.3 The defect being due to the Company’s faulty design, workmanship or materials

10.2 The Company has no liability for damage caused by inappropriate use of the goods or where they have been adversely affected by environmental conditions not present at the time of installation. 

 

  1. Health and Safety

11.1 Other than by agreement with the Company, the Customer will not enter the working space during the installation period.  

 

  1. Welfare and Services

12.1 The Customer will provide welfare facilities for Company operatives throughout the installation period and where necessary will provide power and water free of charge. 

The placing of any order is deemed as acceptance of these Terms and Conditions.
